Open Letter To The Chief Justice of the Federation, Abuja and To Nigerians, come to  my rescue.

The Need To Beam Your Torch light On The Judiciary of Kogi State.

Sir,

I wish to draw the attention of the Chief Justice of the Federation, the Minister of Justice and Attorney General of the Federation, the Chief Justice of Kogi State as well as the Commissioner for Justice and Attorney General of Kogi State, as well as to all well meaning NIgerians to the illegality going on in the Kogi State Judiciary.

Permit me to bring to your notice that on the 18th February, 2025, Justice Yahaya Adamu of the State High Court delivered a judgement where he declared as follows: “The 7th respondents, Enemona Anyebe’s participation in the PDP State Congress of 31/08/2024 is illegal, null and void and hence his purported declaration by PDP as elected official is null and void”.

It is therefore on this premise that I want to draw the attention of the above mentioned recognized authorities, members of the public that following the orders by the Court for the arrest of Enemona Anyebe, he is still parading himself as Chairman of the Party. Permit me to State that instead of declaration, he made a cancellation of the election.

I, therefore wish to call on the Police, the DSS to without delay effect the arrest of the impersonator for still parading himself after the judgement has been delivered over a constitutional matter, as no one, no matter how highly placed, should be above the law.

The 31st August , 2024 PDP election was an election I won, because the person so declared was not qualified to contest as contained in the Judgment. My demand for Justice is predicated on what happened in Zamfara, Bayelsa, Imo, Plateau States and in other places where the runner ups were declared as winners and made to be sworn in, after the purported winners of those elections were earlier declared as not fit to contest.

I was not declared the winner of the election because I was not joined in the suit. But permit me to add that I have now applied to be joined as I was a participant in the election.

Permit me to also add that this election is about me, reason why I have also applied for stay of execution and have sent our notices of appeal and served the parties involved. Unfortunately, releasing the record of proceedings of the Judgment to the Court of Appeal is still being frustrated by the Court.

Enough of this frustration and hoarding of the records of the proceeding just because I have no godfather. Chief Justice of Nigeria, NJC and others mentioned please come to my rescue.

I’m therefore calling on the NJC to beam their searchlight on High Court 5 in Lokoja, so as to enable the poor man breadth in Nigeria.
What I’m demanding for in terms of my declaration as winner of the August 31 Kogi State PDP election is nothing new in the country and in Law.

The time for the Chief Justice of the Federation and others to beam their searchlight on the illegality ongoing in Kogi State Judiciary has therefore become expedient as there is an ongoing efforts by some powers that be to emasculate me and rob of justice.

The Judiciary remains the hope of the common man, reason I’m asking that justice should be done. I therefore call on the Constitutional Lawyers, the Femi Falana’s of Nigeria amongst several others, the Berekete Family as led by Ahmed Ahmed, as I  appeal to you all well meaning Nigerians to beam your Searchlight on the activities of some individuals who are bent on trampling on the pronouncements of the Judiciary in Kogi State and showing that they are above the law and to have the temerity and audacity to still walk the streets, parading themselves as Chairman of the PDP, despite a court pronouncement.

In suit no: HC/OKP/8/2024, Motion No:HC/OKO/55M/2024, the Court on 31st day of July, 2024 made an order against Enemona Anyebe and the respondents from 1-7 are bound to obey.

But  the respondents disobeyed the subsisting orders of the honourable court and made a caricature of themselves when on the 5th September, 2024 the electoral panel disobeyed the court order when there was no appellate court order setting aside the orders made on 31st July, 2024 with suit no HC/OKP/54/2024.

Let me draw the attention of the Attorney General of the Federation and other law enforcement officers in the Country. The Governor’s, particularly, the PDP Governor’s Chairman, that it is clear from the orders made on 31/7/2024 for the PDP not to recognize the 7th respondents, Enemona Anyebe as its member and a candidate, hence all actions taken by the PDP by Enemona Anyebe towards the 31/7/2024 state Congress held on 31/08/2024, abinitio, is therefore null and void and hence of no consequence whatsoever as his declaration as Chairman holds no water.

Let me at this point draw the attention of the world, particularly the mentioned officers as listed earlier that having emerged runner up in the said Congress, I’m the duly elected Chairman of the Kogi State PDP and should be sworn in immediately.

The court in it judgment therefore on 18/2/25 was clear on the issue that the 7th respondents erred in contempt, was not even supposed to have participated, declared him a non participant in the election. Consequently, I ought to have been declared and sworn in as the duly elected Chairman.

From the originating summon, at no point did the plaintiff called for a cancellation of the election, rather wanted a case establishing contempt for which it was specific in the judgement, ought to have made declaration for the runner up to assume leadership and not to order for a fresh election.

While we may not have benefitted from the High Court judgement as postulated by legal experts because we were not a joinder, we have however filed for us to be a joinder in the appeal in dissatisfaction to the call for another Election which was not a prayer in the originating summon.

Similarly, I urge all my supporters to be calm that  at the Federal High Court where before now, we have filed contempt proceedings against Enemona Anyebe. We are grateful that the State High Court has dispensed with the case and await the ruling by the Federal High Court. The time to stop the abuse on our court must stop now with the arrest of Enemona Anyebe and my swearing in as the Chairman of the Kogi State PDP.

We are in a nation where the constitution is supreme and holds that the right thing should be done. To this end, I call on the National Judicial Service Commission, other critical stakeholders to see how the Judiciary in Kogi State is about to rubbish the judgment as Justice delayed is justice denied. Let the Judiciary continue to be the last hope of the common man in Kogi State.

The Chief Justice of the Federation, the NJC and others mentioned should please come to my aid as I have no godfather, with no money as my only sin for not getting justice. Let the proceeding of the High Court 5 be transmitted without the conniavance of any Judicial Officer, working with some alledged powerful people.
